امنه نصير: زواج مسلمة من مشرك حرام بنص القرآن وزواج الكتابى حرام باجتهاد الفقهاء

أصدر مكتب الدكتورة آمنة نصير بيانا بشأن الجدل الدائر حول ما اقتطعه البعض من حديثها على إحدى القنوات الفضائية عن زواج المسلمة من أهل الكتاب ومن ثم اجتزاءه من سياقه، ووضعه كأنه تصريح منها وموافقة منها عليه- حسب ما جاء فى البيان.

وأضاف البيان، أنه جاء تحديدًا أحد أسئلة الحلقة عن وجود نص قرآنى يُحرم زواج المرأة المسلمة من رجل من أهل الكتاب، وكان رد الدكتورة آمنه نصير عليه أنه لا يوجد نص قرآنى صريح فى ذلك الشأن بالتحديد، ولكن التحريم جاء من إجماع الفقهاء كى لا يتسرب الأبناء إلى دين الأب غير المسلم؛ وعليه فهى تؤكد قاطعًا على تأييدها لما جاء من رأى جمهور الفقهاء من تحريم كى لا يتسرب الأبناء أو يتشتت إيمانهم بين الأم المسلمة والأب المنتمى لأهل الكتاب ؛ أما الزواج من مشرك أو مشركة فهو محرمًا تحريمًا قطعيًا لوجود النص القرآنى الصريح بتحريمه، ولا يجوز فيه ثمة اجتهاد من أى نوع.

وأكدت الدكتور آمنة نصير على أهمية التجديد فى الدين وخطابه وضرورة الاجتهاد فى القضايا الفقهية المستجدة دون القضايا التى نزل فيها النص القرآنى، وهو ما عاشت تقوم به طيلة مسيرتها العلمية. وأهابت الدكتورة آمنة نصير بالكافة الالتزام بأمانة الكلمة، وصدق النقل، وعدم الاقتطاع من السياق لتحقيق سبق أو إثارة قضايا جدلية فى وسائل الإعلام ووسائط التواصل الاجتماعي.
