الحكم فى استئناف حنين ومودة الأدهم على حبسهما سنتين

تصدر محكمة مستأنف القاهرة الاقتصادية، اليوم الثلاثاء، حكمها فى استئناف حنين حسام ومودة الأدهم و3 آخرين، على حكم محكمة جنح القاهرة الاقتصادية بمعاقبتهن بالحبس سنتين وغرامة 300 ألف جنيه، لاتهامهن بالتعدى على القيم والمبادئ الأسرية.

وتواجه المتهمتين 9 اتهامات قامت على إثرها النيابة العامة بإحالتهما بصحبة 3 آخرين للجنايات، وهما: “الاعتداء على قيم ومبادئ الأسرة المصرية والمجتمع، اشتركا مع آخرين فى استدراج الفتيات واستغلالهم عبر البث المباشر، ارتكاب جريمة الإتجار بالبشر، تلقيا تحويلات بنكية من إدارة التطبيق مقابل ما حققاه من مشاهدة، نشر فيديوهات تحرض على الفسق لزيادة نسبة المتابعين لها، التحريض على الفسق، عضوتان بمجموعة “واتس أب” لتلقى تكليفات استغلال الفتيات، تشجيع الفتيات المراهقات على بث فيديوهات مشابهة، الهروب من العدالة ومحاولة التخفى وتشفير هواتفهما وحساباتهما”.

وينص القانون فى العقوبة التى تواجه حنين حسام ومودة الأدهم حال إدانتهما بتلك الاتهامات.
فى حالة نشر صور ومقاطع فيديو خادشة للحياء: يعاقب بالحبس مدة لا تزيد على سنتين وبغرامة لا تزيد عن 10 آلاف جنيه أو بإحدى هاتين العقوبتين لكل من نشر صورًا بقصد العرض إذا كانت خادشة للحياء العام، حسبما تنص المادة 178 عقوبات.

الدعوة بالإغراء للدعارة على مواقع التواصل الاجتماعي: يعاقب بالحبس مدة لا تزيد عن 3 سنوات وبغرامة لا تجاوز 100 جنيه لكل من أعلن بأية طريقة من طرق الإعلان دعوة تتضمن إغراء بالفجور أو الدعارة أو لفت الأنظار، وفق المادة 14 من قانون رقم 10 لسنة 1960.

الاعتداء على مبادئ وقيم أسرية فى المجتمع المصري: يعاقب بالحبس مدة لا تقل عن ستة أشهر، وبغرامة لا تقل عن خمسين ألف جنيه ولا تجاوز مائة ألف جنيه، أو بإحدى هاتين العقوبتين، كل من اعتدى على أى من المبادئ أو القيم الأسرية فى المجتمع المصرى (المادة 25 من قانون 175 لسنة 2018) فى شأن مكافحة جرائم تقنية المعلومات.

إنشاء حساب وإدارته على الإنترنت للتحريض على الفجور: يُعاقب بالحبس مدة لا تقل عن سنتين وبغرامة لا تقل عن مائة ألف جنيه, ولا تزيد عن ثلاثمائة ألف جنيه, أو بإحدى هاتين العقوبتين، كل من أنشأ أو أدار أو استخدم موقعًا أو حسابًا خاصًا على شبكة معلوماتية يهدف إلى ارتكاب أو تسهيل ارتكاب جريمة معاقب عليها قانونًا (المادة 27).
