السجن 5 سنوات .. عقوبة ختان الإناث

وافق مجلس الوزراء على مشروع قانون بتعديل بعض أحكام قانون العقوبات الصادر بالقانون رقم 58 لسنة 1937، لتقرير عقوبة رادعة حيال جرائم ختان الإناث، وجاءت التعديلات في المادتين (242 مكررا)، و (242 مكررا أ ).

ونص التعديل في المادة ( 242 مكررا) على أن “يُعاقب بالسجن مدة لا تقل عن خمس سنوات كل من أجرى ختاناً لأنثى بإزالة جزء من أعضائها أو سوّى، أو عدّل، أو شوّه، أو ألحق إصابات بتلك الأعضاء، فإذا نشأ عن ذلك الفعل عاهة مُستديمة، تكون العقوبة السجن المشدد، لمدة لا تقل عن 7 سنوات، أما إذا أفضى الفعل إلى الموت، تكون العقوبة السجن المشدد، لمدة لا تقل عن 10 سنوات”.

كما نص التعديل، في هذه المادة، على أن تكون العقوبة السجن المشدد إذا كان من أجرى الختان طبيباً أو مُزاولاً لمهنة التمريض، فإذا نشأ عن جريمته عاهة مستديمة تكون العقوبة السجن المُشدد لمدة لا تقل عن 10 سنوات، أما إذا أفضى الفعل إلى الموت تكون العقوبة السجن المشدد، لمدة لا تقل عن 15 سنة، ولا تزيد على 20 سنة.

ووفقا للتعديل، تقضي المحكمة فضلاً عن العقوبات، المتقدم ذكرها، بعزل الجاني من وظيفته الأميرية، مدة لا تزيد على 5 سنوات إذا ارتكبت الجريمة بسبب أو بمناسبة تأدية وظيفته، وحرمان مرتكبها من ممارسة المهنة لمدة مماثلة،

وغلق المنشأة الخاصة التي أُجرى فيها الختان، وإذا كانت مُرخصة تكون مدة الغلق مُساوية لمدة المنع من ممارسة المهنة، مع نزع لوحاتها ولافتاتها، سواء أكانت مملوكة للطبيب مُرتكب الجريمة، أو كان مديرها الفعليّ عالماً بارتكابها، وذلك بما لا يخل بحقوق الغير حسن النية، ونشر الحكم في جريدتين يوميتين واسعتي الانتشار وبالمواقع الإلكترونية التي يُعينها الحكم على نفقة المحكوم عليه.

كما نصت التعديلات في المادة (242 مكررا أ ) على أن ” يُعاقب بالسجن كل من طلب ختان أنثى وتم ختانها بناء على طلبه، على النحو المنصوص عليه بالمادة (242 مكررا)، كما يُعاقب بالحبس كل من روّج، أو شجع، أو دعا بإحدى الطرق المبينة بالمادة (171) لارتكاب جريمة ختان أنثى ولو لم يترتب على فعله أثر”.​
